Digittle

Effective 2026-10-27

Terms of Service

These terms describe the agreement for using Digittle, including account access, research outputs, intellectual property and the commercial terms stated in your order. They apply when accepted by an authorized customer representative.

1 The parties and agreement

Digittle is provided by DIGITTLE LLC, a Missouri limited liability company, with its principal office at 3954 Arsenal St, Saint Louis, MO 63116-3902, USA. In these terms, “Digittle,” “we” and “us” mean that entity. “Customer” means the business identified in the accepted order, or the individual accepting these terms for an authorized business purpose.

You must be at least 18 and have authority to enter this agreement. An order, including a subscription confirmed in checkout, identifies the purchased scope, service period and fees. An order controls its specific commercial terms; a signed Data Processing Addendum controls the personal-data processing it covers. These terms and the Acceptable Use Policy otherwise govern use of the platform.

2 Access and account responsibilities

We grant Customer a limited, nonexclusive right to access the purchased service during its service period. Each authorized user must use an individual account. Customer manages invitations, permissions and prompt removal of users who should no longer have access. Protect credentials and report suspected misuse promptly through the agreed support channel. Access is limited to the brands, clients, users and usage included in the order.

3 What the service provides

Digittle organizes selected public and customer-provided information into market research, comparisons, AI visibility observations, recommendations, briefs and reports. Coverage depends on the selected scope and available sources. Third-party services, source availability and assistant responses can change. A missing result does not prove inactivity or a market gap. Estimates of execution lift or potential payoff are judgments, not forecasts or guaranteed returns.

Customer decides whether and how to act. Review source evidence, permissions and regulated claims before publishing or relying on outputs. The service does not replace legal, financial, medical or other professional advice. No uptime commitment or guaranteed business result applies unless expressly agreed in an order.

4 Customer content

Customer retains its rights in its inputs and branding. Customer grants Digittle permission to host, process and display those inputs as reasonably needed to provide, secure and support the service, including through applicable service providers. Customer must have authority to supply the material and appropriate instructions for any personal data. Do not submit patient records, health information about identifiable people, passwords, full payment credentials or other prohibited sensitive data.

5 Ownership and permitted output use

Digittle retains its software, collection methods, analytical workflows, scoring framework, designs and branding. Subject to payment and the order, Customer may use exported original Digittle analysis for its own business and, where the order permits agency use, for the named client. No ownership of Digittle technology transfers.

Articles, posts, advertisements, images, quotations and third-party marks retain their owners’ rights. Their inclusion in research does not give Customer an unrestricted right to republish them. Keep attribution and check licensing, platform terms and permission before reuse. Do not reverse engineer or extract nonpublic methods except to the extent a restriction is prohibited by applicable law.

6 Fees renewal and cancellation

Monthly subscriptions are Essentials at US $299, Intelligence at US $599, and Agency at US $1,499, plus applicable taxes disclosed before purchase. Your selected plan, included scope and usage appear in the pricing page and checkout. The subscription renews monthly at the disclosed price until canceled. Customer authorizes Stripe to collect the initial and recurring charges only when completing the paid checkout; creating an account alone does not authorize a charge. Additional paid credits or other purchases require separate authorization. Monthly usage limits continue to apply; unused monthly allowance does not automatically become a cash balance or refund.

You may cancel at any time through Settings → Billing → Manage billing, or contact info@digittle.ai if you cannot access the portal. Cancellation takes effect at the end of the paid billing period, and paid access continues through that period. Cancellation does not produce a prorated refund, except where required by law or under the service-failure remedy in section 9. Plan upgrades show the prorated charge for your confirmation in Stripe; paid access changes after payment confirmation. Plan downgrades take effect at the end of the paid period. A failed or unpaid subscription can suspend new paid research; the application does not delete saved research merely because a subscription ends. Do not send payment-card information through ordinary support messages.

7 Confidentiality and privacy

Each party will use reasonable care to protect the other party’s nonpublic business information and use it only to perform or enforce this agreement. Disclosure is permitted to personnel, professional advisers and providers with a need to know and appropriate confidentiality obligations, or as required by law. Where lawful, give advance notice of a compelled disclosure. Public information and information independently developed or lawfully received without restriction are excluded.

The Privacy Policy explains Digittle’s handling of personal information. Customer-controlled processing may also require a signed DPA. The AI and Data Sources statement explains source provenance and interpretation limits; it does not authorize unrelated uses of Customer information or waive privacy rights.

8 Suspension and termination

We may temporarily restrict access where reasonably necessary to address a security threat, unlawful use or material breach. We will limit the restriction where practicable and explain the reason unless doing so would compromise security or violate law. Either party may terminate for a material breach not corrected within 30 days after written notice. Serious unlawful conduct or misuse posing an immediate risk may justify earlier action.

At termination, paid research access ends according to the subscription or order. Export the material you need while your account is available. Ending a subscription does not itself request deletion of account data. Contact info@digittle.ai to request account closure, deletion or help returning your data; any separately signed order or DPA governs its agreed return and deletion arrangements. Confidentiality, accrued payment obligations, ownership, permitted use of retained exports and provisions intended to survive remain effective.

9 Service warranty and remedy

We will provide the service with reasonable care and skill and materially in accordance with the accepted order. Customer should report a material failure with enough detail for investigation. We will use reasonable efforts to correct it. If we cannot do so within a reasonable period, Customer may terminate the affected service and receive a proportional refund of prepaid fees for the unused affected period.

Except for express commitments and rights that cannot lawfully be excluded, the service is provided without other warranties. We do not warrant that every third-party statement is accurate, that every source will remain accessible, or that a recommendation will deliver a particular result. Customer modifications to exported narrative are Customer’s responsibility.

10 Allocation of risk

To the extent permitted by law, neither party is liable for indirect or consequential loss, lost opportunity or lost profits arising from this agreement. Each party’s total liability arising from the agreement is limited to the fees paid or payable under the affected order during the 12 months preceding the event giving rise to the claim.

These limits do not exclude fraud, intentional misconduct, Customer’s payment obligations or liabilities that applicable law does not permit the parties to limit. Any separate negotiated confidentiality, security or intellectual-property risk allocation must be recorded in the signed order or DPA.

11 Changes and disputes

We will notify Customer of material changes to these terms before they take effect. A change will not retroactively alter an accepted order without agreement, except where required by law. We will obtain fresh acceptance where required. If a proposed material change is unacceptable, the parties should resolve the remaining service period under the existing order.

The parties will first try in good faith to resolve a dispute through their designated contacts. Subject to mandatory law and any signed order, Missouri law governs, without its conflict-of-law rules, and the state or federal courts located in St. Louis, Missouri have jurisdiction. These terms do not require arbitration or waive participation in a class action.

12 Notices and policy version
